We are dashflow GmbH ("Company," "we," "us," "our"), a company registered in Switzerland at
Meiershofstrasse, 8600 Dübendorf, Switzerland.
We operate the website https://www.dash-flow.io
(the "Site"), as well as any other related products and services that refer or link to these legal terms
(the "Legal Terms") (collectively, the "Services").
We provide a web-based software to connect and import marketing channel data from third parties and combine
them into a single data-file.

These Legal Terms constitute a legally binding agreement made between you and dashflow GmbH concerning your
access to and use of the Services. If you do not agree with all of these legal terms, you are prohibited from
using the Services and must discontinue use immediately.
We will provide prior notice of any scheduled changes to the Services you are using. By continuing to use
the Services after the effective date of changes, you agree to be bound by the modified terms.
The Services are intended for users who are at least 18 years old. Persons under 18 are not permitted to
use or register for the Services.
We recommend that you print a copy of these Legal Terms for your records.

The information provided when using the Services is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or would subject us to registration requirements in such jurisdiction or country.

Your use of our Services
Subject to compliance with these Legal Terms, we grant you a non-exclusive, non-transferable, revocable license to access the Services and download or print a copy of portions of the Content solely for your internal business purpose.
Except as set out in these Terms, no part of the Services or Content may be copied, reproduced, distributed, sold, licensed, or otherwise exploited for commercial purposes without prior written permission.

3. USER REPRESENTATIONS
By using the Services, you represent and warrant that: (1) all registration information is accurate and complete; (2) you maintain and update such information; (3) you have legal capacity; (4) you are not a minor in your jurisdiction; (5) you do not access via automated means; (6) you do not use for illegal or unauthorized purposes; and (7) your use complies with applicable laws.
If information is untrue, inaccurate, outdated, or incomplete, we may suspend or terminate your account and refuse current or future use.
4. USER REGISTRATION
You may be required to register to use the Services. You are responsible for confidentiality of your password and all account activity. We may remove or change usernames deemed inappropriate, obscene, or objectionable.
5. PURCHASES AND PAYMENT
Accepted forms of payment: Visa, Mastercard, Invoice.
You agree to provide current, complete, and accurate purchase and account information, and promptly update it. We may change prices at any time. Sales tax may be added where required. All payments shall be in bill specific.
We may refuse orders and limit or cancel quantities purchased per person, household, or order.
6. SUBSCRIPTIONS
Billing and Renewal
Your subscription continues and renews automatically unless canceled. Billing cycle depends on your selected plan.
Free Trial
We offer a 7-day free trial. At the end, the account will be charged according to the chosen subscription.
Cancellation
All purchases are non-refundable. You can cancel your subscription at any time by contacting us. Cancellation takes effect at the end of the current paid term. Contact: hello@dash-flow.io.
Fee Changes
We may change subscription fees and communicate changes in accordance with applicable law.
7. PROHIBITED ACTIVITIES
You may not access or use the Services for purposes other than intended. Prohibited activities include (without limitation): unauthorized data scraping, fraud, circumventing security, harassment, unlawful use, unauthorized framing/linking, malware transmission, automated scripts/robots, deleting notices, impersonation, reverse engineering (except as allowed by law), unauthorized account creation, and use to compete with us.
8. USER GENERATED CONTRIBUTIONS
The Services do not offer users to submit or post content.
9. CONTRIBUTION LICENSE
You and Services agree that we may access, store, process, and use information and personal data you provide according to the Privacy Policy and your settings. By submitting feedback, you agree we may use it without compensation.
You may link third-party accounts to the Services where supported, subject to third-party terms. Your relationship with third-party providers is governed by your agreements with them. We are not responsible for third-party account content.
11. THIRD-PARTY WEBSITES AND CONTENT
Services may include links to third-party websites and content. We are not responsible for their accuracy, legality, or practices. Use third-party resources at your own risk.
12. SERVICES MANAGEMENT
We may monitor for violations, take legal action, remove burdensome content, and manage Services to protect rights and proper functionality.
13. PRIVACY POLICY
Please review our Privacy Policy: https://www.dash-flow.io/privacy-policy. By using the Services, you agree to be bound by our Privacy Policy. Services are hosted in Switzerland.
14. TERM AND TERMINATION
These Terms remain in force while you use the Services. We may deny access, terminate use, or delete accounts/content at our sole discretion for breaches or legal reasons.
15. MODIFICATIONS AND INTERRUPTIONS
We may modify, suspend, or discontinue Services at any time without notice. We are not liable for downtime or interruptions.
16. GOVERNING LAW
These Terms are governed by Switzerland law. The courts of the Canton of Zurich have non-exclusive jurisdiction, with consumer rights preserved where mandatory law applies.
17. DISPUTE RESOLUTION
EU consumers may access the EU online dispute resolution platform: https://ec.europa.eu/consumers/odr.
18. CORRECTIONS
We may correct typographical errors, inaccuracies, or omissions on the Services at any time without prior notice.
19. DISCLAIMER
THE SERVICES ARE PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED.
20. LIMITATIONS OF LIABILITY
IN NO EVENT WILL WE BE LIABLE FOR INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES. LIABILITY IS LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO US DURING THE ONE (1) MONTH PERIOD PRIOR TO THE CAUSE OF ACTION, TO THE EXTENT PERMITTED BY LAW.
21. INDEMNIFICATION
You agree to defend, indemnify, and hold us harmless from claims arising from your use of the Services, breach of Terms, violation of law, or infringement of third-party rights.
22. USER DATA
We maintain certain data for service performance and backups. You are responsible for transmitted data. We are not liable for loss/corruption of such data.
23. ELECTRONIC COMMUNICATIONS, TRANSACTIONS, AND SIGNATURES
You consent to electronic communications, signatures, contracts, and records and waive requirements for non-electronic originals where permitted by law.
24. CALIFORNIA USERS AND RESIDENTS
Complaints may be addressed to the Complaint Assistance Unit, Division of Consumer Services, California Department of Consumer Affairs.
25. MISCELLANEOUS
These Legal Terms and posted policies form the entire agreement between you and us. If any provision is unlawful or unenforceable, remaining provisions remain in effect.
26. SERVICE & SUPPORT
In case of data-pipeline update failures, we will act promptly to mitigate and resolve. We are not liable for failures caused by third-party platform outages.
27. SLA
If you contact support at support@144843335.eu1.r.hubspot-inbox.com, we will respond within 24 hours.
28. TERMINATION FOR IMPROPER CONDUCT OR LEGAL RISK
We may terminate with immediate effect if customer conduct presents legal, reputational, or operational risk, including criminal investigation, unethical behavior, harassment, material legal action, or circumstances making continued cooperation unworkable.
29. GOVERNING LAW AND JURISDICTION (SUPPLEMENT)
These Legal Terms are governed by Swiss substantive law, excluding conflict rules and CISG. Disputes shall be submitted to competent courts in Zurich, Switzerland, to the extent permitted by law.
